1. Acceptance of Terms
By accessing or using the AkBaat website (www.akbaat.com), mobile application, or any related services (collectively, the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree, you must not use the Service.
These terms constitute a legally binding agreement between you ("User," "you," or "your") and AkBaat ("we," "us," or "our"), a business registered in Kasur, Punjab, Pakistan.
2. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.
3. Account Registration
- You may create an account or use the Service as a guest.
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate, current, and complete information during registration and to update it as necessary.
- You are responsible for all activity that occurs under your account.
- We reserve the right to suspend or terminate accounts that violate these terms or are used for fraudulent purposes.
4. Products and Pricing
- Product images on the Service are for illustrative purposes only. Actual products may differ in appearance, packaging, or quantity.
- Prices are displayed in Pakistani Rupees (PKR) and include applicable taxes unless stated otherwise.
- We reserve the right to change prices at any time without prior notice. The price applicable to your order is the price displayed at the time of order placement.
- In the event of a pricing error, we reserve the right to cancel the order and issue a full refund.
- Product availability is subject to stock availability with our suppliers. We do not maintain warehouse inventory.
5. Orders and Acceptance
- Placing an order constitutes an offer to purchase products. We reserve the right to accept or reject any order at our sole discretion.
- An order is confirmed only when you receive an order confirmation via SMS, email, or in-app notification.
- We may cancel orders due to product unavailability, pricing errors, suspected fraud, or delivery area restrictions.
- Orders are limited to our designated delivery zones within Kasur, Punjab.
6. Payment
- Currently, we accept Cash on Delivery (COD) only.
- Payment is due in full at the time of delivery.
- You agree to pay the total amount shown at checkout, including product charges, delivery fees, and any applicable surcharges.
- Future payment methods (e.g., online payments) may be added. Such methods will be subject to additional terms and conditions.
- We reserve the right to limit or refuse COD orders based on order history or suspected fraud.
7. Delivery
Delivery is subject to our Shipping & Delivery Policy. Key terms:
- Delivery is available only within configured delivery zones in Kasur, Punjab.
- Standard and Express delivery are both same-day; Express receives priority handling.
- Delivery timelines are estimates and not guaranteed. Delays may occur due to weather, traffic, or unforeseen circumstances.
- Orders above Rs. 5,000 qualify for free standard delivery.
- An express delivery surcharge of Rs. 150 applies to Express orders.

9. User Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Provide false or misleading information
- Attempt to gain unauthorized access to our systems or other user accounts
- Interfere with or disrupt the Service or its infrastructure
- Use automated tools (bots, scrapers) to access the Service without written permission
- Engage in fraudulent activities including placing orders with no intention to pay (COD fraud)
- Harass, abuse, or threaten our delivery personnel or support staff
Violation of these terms may result in immediate account suspension or termination and, where applicable, legal action.
10. Intellectual Property
All content on the Service, including text, graphics, logos, images, software, and trademarks, is the property of AkBaat or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
11. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
- We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
- Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid for the order giving rise to the claim.
- We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
- We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, government actions, power outages, or internet disruptions.
12. Indemnification
You agree to indemnify and hold harmless AkBaat, its owners, employees, and affiliates from any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising from your use of the Service, violation of these terms, or violation of any rights of a third party.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of Pakistan. Any disputes arising from these terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts in Kasur, Punjab, Pakistan.
14. Modifications
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Service. Your continued use after changes are posted constitutes acceptance of the modified Terms. We will notify you of material changes via email or in-app notification where feasible.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
